UK Spouse Visa Accommodation Requirements 2026

One of the requirements for a UK Spouse or Partner Visa is demonstrating that the applicant applying for the visa will have adequate accommodation in the UK when they arrive. The accommodation must be available without relying on public funds and must not be overcrowded or breach relevant public health regulations.

Please note that every case is unique and should be assessed by a qualified immigration adviser to ensure a tailored approach and give the applicant the best possible chance of success.

What counts as adequate accommodation?

The property should be legally occupied or owned and suitable for the family living there. This means that the accommodation must follow the rules in the Housing Act 1985.

The accommodation must meet the relevant statutory overcrowding standards, taking into account the number, age and circumstances of the people living in the property.

For example, if the Sponsor Partner living in the UK or arranging the accommodation in the UK is renting a 2 bedroom flat with another flatmate, the document necessary for the application would be:

  • A floor plan showing the measurements which proves the flat will be suitable

  • A letter from the flatmate approving the new future tenant (Partner)

  • Proof that the landlord accepts new tenant (Letter from the Landlord)

  • Pictures of all the rooms of the flat (Kitchen, bathroom, bedrooms).

Depending on the circumstances, evidence that needs to be provided include tenancy agreements, title deeds, landlord letters, property inspection reports and evidence showing who currently lives at the property.

We recommend providing a property inspection report if there are others living in the house/flat and a floor plan is not available for you to use.

So, applicants do not necessarily need to rent or own an entire property themselves. Accommodation can be shared with relatives or others, provided there is exclusive use of at least the necessary part of the accommodation, such as the required bedroom.

Meeting the adequate accommodation requirement is an important part of a UK Spouse Visa application. Applicants must show that there will be suitable accommodation available for them and their family in the UK, without relying on public funds and without the property becoming overcrowded.

It is important to check that all accommodation evidence is up to date and relevant to your circumstances before submitting your application.
