When can I apply for ILR after 5 years on the Spouse or Partner Visa in the UK?
You can apply after 4 years and 11 months of being on the Spouse Visa, as Immigration rules allow you to submit an ILR application 28 days before qualifying for ILR. You must submit an application before your current visa expires, to prevent overstaying in the U.K.
We recommend starting the process early, to prevent last minute applications without preparing all the required documents.
Will I need to pass an English Language Test in order to apply for ILR?
Yes, you will need to meet the English language requirement which is B1.
Please note: from March 26, 2027 onwards, the English Language requirement for settlement applications will be B2.
You will also need to pass a Life in the UK test.
Am I eligible to apply for ILR on a Fiancé visa?
No, you must strictly be on a Spouse or Partner Visa to be eligible for ILR.
What is the income requirement to apply for ILR on a Spouse or Partner Visa?
If you applied for your first visa before 11 April 2024 you will need a combined income of at least £29,000.
If you applied for your first visa before 11 April 2024, you must show a combined income of at least £18,600 a year.
What are the residency requirements to apply for ILR on a Spouse Visa?
You must show that you have lived continuously for at least 5 years in the U.K. Unlike ILR for work visas, there are no strict absence limits. However, it is best to keep on the safe side, keep long-term travel limited, and explain any absences in your application.
