UK Sponsor License - Pre-License Compliance Interview Questions and Answers

A Home Office compliance visit, either pre license or post license, is an inspection undertaken by the Home Office to verify compliance to determine a sponsor licence application or as part of ongoing monitoring throughout the licence’s validity.

The Home Office reserves the right to carry out pre-licence checks where there are concerns regarding the adequacy or sufficiency of the evidence provided in a sponsor licence application. In cases where a compliance check cannot be carried out, the application will be assessed based on the information submitted, which may lead to refusal.

The pre license compliance check will usually be carried out online, via a Teams meeting.

The main thing that they will be checking for, during this compliance interview is:

-You have established HR and recruitment procedures to ensure compliance with sponsor duties;

-The vacancy constitutes genuine employment;

-The role meets the prescribed skill level and minimum salary requirements;

-You may present a threat to the integrity of immigration control.

Example questions asked during the compliance check interview:

What does your business do?

How long has the company been trading?

Why do you need a sponsor license?

Who prepared and submitted the sponsor license application? Was any external help used?

How do you ensure right to work checks are done properly? What is your process?

Which qualifications are you looking for in applicants?

Please note: The HO caseworker may ask the Authorising Officer to share their screen. This can be for showing HR systems or pension schemes related questions.
